Terms of Use

Plain language on purpose — the terms should sound like the app.

The deal

Earnest is for adults (18+) genuinely trying to meet someone. You get introductions, conversation, and tools built around one idea: say what you mean, do what you said. In exchange you agree to the rules below — they’re the product, not fine print.

The rules

  1. Be you. Your photos are you, current enough that the month on them isn’t a lie. Verification exists; impersonation is removal.
  2. One account, yours. No selling, sharing, or operating accounts for others.
  3. Kept words count. Confirmed dates are on the record. Both sides check in afterward — structured answers, double-blind. No-shows, photo mismatches, and misconduct become private strikes reviewed by a human. Chat silence is never punished.
  4. No commerce, no spam, no scams. Solicitation of any kind is removal, and the identity is banned from returning.
  5. Respect the double-blind. Attempting to game check-ins, retaliate, or harass is enforcement territory.
  6. Calls are private. Never record them. We can’t and don’t; neither may you.

To keep Earnest safe and working as intended, you agree not to:

Enforcement

A human (today: the founder) reviews every report. The ladder is pause → removal; nothing is automated, and removal keeps a minimal evidence ledger (see the Privacy Policy). We may refuse or revoke access to protect members.

Account Termination

You may delete your account at any time in Settings. Earnest may suspend or terminate accounts that violate these Terms, consistent with the enforcement ladder above.

Your content

Content you post stays yours; you license us to display it inside Earnest to the people your settings imply — nothing more.

Check-in signals and badges

Structured check-in signals are member-submitted opinions processed double-blind; badges represent patterns of received signals, not Earnest’s own factual assertions about any person.

Beta Disclaimer

Earnest is currently offered as a beta service. Features may change, be interrupted, or be discontinued at any time. We make no guarantee that the service will be uninterrupted or error free.

Limitation of Liability

To the maximum extent permitted by law, Earnest and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the service.

Our total liability for any claim relating to the service will not exceed the greater of:

Dispute Resolution

Except where prohibited by law, disputes arising from these Terms will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Arbitration will take place in New Jersey unless both parties agree otherwise.

You and Earnest each waive any right to participate in class actions or class arbitration.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Changes to these Terms

We may update these Terms from time to time.

Material changes will become effective after reasonable notice through the application or by email where appropriate.

Continued use of Earnest after the effective date constitutes acceptance of the updated Terms.
